2. Applicability

2.1 These Terms apply to purchases made through the Visual Computers website, physical store, authorised sales channels, or other sales channels operated or expressly authorised by Visual Computers.

2.2 Certain products or services may be subject to additional product-specific terms, manufacturer warranty conditions, licensing terms, promotional terms, quotations, or service agreements. Where applicable, those additional terms will be communicated to the Customer.

2.3 If there is a conflict between these Terms and a mandatory requirement of applicable law, the applicable law will prevail.

2.4 Nothing in these Terms is intended to exclude, restrict, or waive any statutory right or remedy that cannot lawfully be excluded or restricted.

3. Product Information

3.1 We endeavour to ensure that product descriptions, photographs, specifications, compatibility information, dimensions, colours, availability information, and other product details displayed on our website are accurate and up to date.

3.2 Product images are provided for illustrative purposes. Actual products may vary slightly in appearance, packaging, labelling, accessories, or revision where the manufacturer has made a legitimate product or packaging change.

3.3 Manufacturer specifications and product features may change without prior notice. Where a manufacturer changes a product specification after publication of a listing, we will make reasonable efforts to provide the relevant information.

3.4 Customers are responsible for reviewing product specifications and compatibility requirements before purchasing, particularly for computer components such as RAM, SSDs, CPUs, GPUs, motherboards, power supplies, networking equipment, and other components requiring system compatibility.

3.5 Where compatibility information is uncertain or product selection depends upon the Customer's existing hardware, the Customer is encouraged to contact Visual Computers before placing the order.

4. Product Availability

4.1 All products are subject to availability.

4.2 Displaying a product on our website does not necessarily constitute a guarantee that the product will remain available until an order is placed and accepted.

4.3 If a product becomes unavailable after an order has been placed, we may contact the Customer regarding an alternative product, revised delivery schedule, or cancellation and refund, as applicable.

4.4 Where an order cannot reasonably be fulfilled, any amount paid for the unfulfilled portion will be handled in accordance with applicable law and the circumstances of the transaction.

5. Prices, Taxes and Charges

5.1 Prices displayed on the website will be those applicable at the time of purchase, subject to obvious pricing errors and any terms expressly stated for a particular product or promotion.

5.2 Unless otherwise stated, applicable taxes, including GST where applicable, will be reflected in the price or disclosed separately as required by law.

5.3 Delivery charges, installation charges, handling charges, extended warranty charges, or other optional charges may apply depending on the order and delivery location. Such charges will be disclosed where applicable before purchase.

5.4 In the event of an obvious typographical, technical, system, or pricing error, Visual Computers may take appropriate corrective action, subject to applicable law and the Customer's statutory rights.

5.5 Promotional prices and discounts may be subject to specific terms, eligibility requirements, validity periods, quantity restrictions, or stock availability.

6. Orders

6.1 An order placed through our website constitutes a request to purchase the selected products.

6.2 Order acknowledgement, confirmation email, SMS, or similar communication does not necessarily constitute final acceptance where the order remains subject to verification, stock availability, payment confirmation, or other reasonable checks.

6.3 We may contact the Customer to verify an order where reasonably necessary, including where there is a payment issue, address discrepancy, unusually large quantity, suspected fraudulent activity, or other legitimate concern.

6.4 We reserve the right to cancel or decline an order where:

  • the product is unavailable;

  • payment cannot be verified;

  • information supplied by the Customer is materially inaccurate;

  • the order appears fraudulent or abusive;

  • the order results from an obvious technical or pricing error; or

  • fulfilment is prevented by circumstances beyond our reasonable control.

6.5 Where an order is cancelled after payment has been received, the amount applicable to the cancelled portion will be refunded in accordance with applicable law and the applicable payment method.

7. Payment

7.1 Payment must be made through the payment methods made available by Visual Computers or its authorised payment service providers.

7.2 The Customer represents that they are authorised to use the payment method selected for the transaction.

7.3 We do not ordinarily receive or store complete payment-card credentials where payment is processed through a third-party payment service provider. Payment processing may be subject to the terms and privacy policies of the relevant payment provider.

7.4 Orders may remain pending until payment is successfully authorised or confirmed.

7.5 If a payment is reversed, charged back, disputed, or otherwise not successfully settled, Visual Computers may suspend fulfilment or seek appropriate clarification, subject to applicable law.

8. Delivery and Shipping

8.1 We will endeavour to dispatch accepted orders within the estimated timeframe communicated at the time of purchase.

8.2 Delivery dates and estimates are indicative unless a specific delivery commitment has been expressly agreed.

8.3 Delivery may be affected by factors including courier delays, weather, transportation disruptions, public holidays, remote-location restrictions, strikes, regulatory restrictions, force majeure events, or other circumstances beyond our reasonable control.

8.4 The Customer must provide a complete and accurate delivery address and contact information.

8.5 The Customer should inspect the outer packaging at the time of delivery, where reasonably possible.

8.6 If the package appears visibly damaged, tampered with, opened, or materially compromised, the Customer should record the condition and contact Visual Computers as soon as reasonably possible.

8.7 For products where transit damage, missing components, or incorrect delivery is alleged, Visual Computers may request photographs, videos, packaging information, serial numbers, delivery documentation, or other reasonable evidence to investigate the matter.

8.8 Any such documentation requirements are intended to facilitate investigation and shall not be interpreted as removing any statutory rights available to the Customer.

9. Order Cancellation

9.1 A Customer may request cancellation of an order before dispatch by contacting Visual Computers as soon as reasonably possible.

9.2 Cancellation requests after dispatch may be subject to the applicable shipping, return, and refund procedures.

9.3 Certain products may not be cancellable after activation, customisation, configuration, or commencement of a service, except where cancellation is required by applicable law or expressly agreed otherwise.

9.4 Where a refund is applicable, it will generally be processed through the original payment method or another lawful method agreed with the Customer.

10. Returns, Replacements and Refunds

10.1 Returns, replacements and refunds are governed primarily by our Return Policy, together with any applicable manufacturer warranty and applicable law.

10.2 Our current Return Policy provides that returns may be considered for defective products, products damaged on arrival, incorrectly supplied products, and other products eligible under the applicable warranty or return terms.

10.3 Returned products may be inspected before a remedy is determined.

10.4 Depending on the circumstances and applicable law, the available remedy may include:

  • repair;

  • replacement;

  • refund; or

  • another appropriate remedy.

10.5 Visual Computers will not use these Terms to deny a remedy that is required under applicable consumer-protection law.

10.6 Products returned due to misuse, unauthorised modification, improper installation, physical damage caused after delivery, or unauthorised repair may be excluded from a warranty or return remedy to the extent permitted by applicable law.

10.7 Customers should retain invoices, serial numbers, packaging, accessories, manuals, warranty cards, and other documentation until the applicable return or warranty period has ended.

10.8 A Customer should not send a product back without first obtaining return instructions from Visual Computers, except where otherwise required by law.

11. Dead-on-Arrival and Transit-Damaged Products

11.1 If a product appears to be defective immediately upon delivery or is damaged during transit, the Customer should notify Visual Computers promptly.

11.2 We may request reasonable information or evidence, including photographs, videos, packaging photographs, serial numbers, courier documentation, or diagnostic information.

11.3 Depending on the nature of the issue, Visual Computers may arrange inspection, replacement, repair, or another appropriate remedy.

11.4 Where the manufacturer requires a product to be examined by an authorised service centre, the Customer may be asked to follow the applicable manufacturer warranty process.

11.5 Nothing in this section limits any remedy available to the Customer under applicable law.

12. Manufacturer Warranty

12.1 Many IT products are covered by manufacturer warranties. The duration, scope, exclusions, and method of claiming warranty may vary by product and manufacturer.

12.2 Unless expressly stated otherwise, Visual Computers does not independently extend, modify, or guarantee a manufacturer's warranty.

12.3 Where appropriate, Visual Computers may assist the Customer in communicating with the manufacturer or authorised service centre.

12.4 Manufacturer warranty terms may contain exclusions relating to physical damage, liquid damage, misuse, improper installation, unauthorised modification, serial-number alteration, software issues, consumable components, or other specified circumstances.

12.5 Where Visual Computers provides its own warranty or service warranty, the specific terms applicable to that warranty will be communicated separately.

13. Computer Components and Compatibility

13.1 Computer components may depend upon compatibility with the Customer's existing hardware, BIOS/UEFI version, operating system, motherboard, power supply, firmware, drivers, physical dimensions, interfaces, or other technical requirements.

13.2 Visual Computers is not responsible for incompatibility resulting solely from the Customer selecting a product without verifying the relevant requirements, except where the product was incorrectly described, supplied, or otherwise subject to a legally applicable defect or deficiency.

13.3 Customers requiring assistance with component selection are encouraged to contact Visual Computers before purchase.

14. Custom-Built and Configured Computers

14.1 Custom-built, assembled, configured, upgraded, or specially ordered systems may contain components selected specifically according to the Customer's requirements.

14.2 Cancellation, modification, return, or replacement of such systems may be subject to additional terms communicated before or at the time of purchase.

14.3 Where a custom-built system contains a defective component, Visual Computers may diagnose the system and determine the appropriate repair or warranty process in accordance with the applicable warranty and law.

14.4 Data stored on a computer submitted for repair or warranty service may be lost, altered, or become inaccessible. Customers should maintain appropriate backups before handing over a system for service.

14.5 Nothing in this section excludes any remedy that cannot lawfully be excluded.

15. Software, Digital Products and Licence Keys

15.1 Software and digital products may be supplied subject to the applicable manufacturer's or publisher's licence terms.

15.2 Product keys, licence keys, activation codes, subscriptions, downloads, and other digital products may be non-returnable after activation or delivery where permitted by applicable law and where the relevant condition was disclosed before purchase.

15.3 The Customer is responsible for complying with the applicable software licence and usage restrictions.

15.4 Visual Computers does not provide rights beyond those granted by the relevant software publisher or licensor.

16. Product Use and Installation

16.1 Customers should follow the manufacturer's installation, operating, maintenance, safety, and usage instructions.

16.2 Improper installation, electrical damage, overheating, liquid damage, physical damage, unauthorised modification, or use outside the manufacturer's specifications may affect warranty eligibility.

16.3 Customers should use appropriately rated power supplies, cables, adapters, surge protection, cooling systems, and other equipment where required.

16.4 Where installation is performed by Visual Computers or an authorised technician, the scope of that service will depend on the service purchased.

17. Data Backup

17.1 Customers are responsible for maintaining appropriate backups of their data.

17.2 Before submitting any computer, storage device, laptop, desktop, phone, networking device, or other equipment for repair, upgrade, installation, warranty evaluation, or service, the Customer should back up important data.

17.3 Visual Computers will take reasonable care when handling equipment but cannot guarantee that data will not be lost, corrupted, altered, or become inaccessible during diagnosis, repair, replacement, firmware updates, operating-system installation, formatting, or other technical work.

17.4 Where technically and legally appropriate, customers may be asked to provide necessary passwords or access credentials for service. Customers should provide only the access information reasonably necessary for the requested service.

18. Promotions, Discounts and Offers

18.1 Promotional offers may be subject to separate terms, validity periods, product exclusions, quantity limits, and eligibility requirements.

18.2 Unless expressly stated otherwise, promotional offers cannot be combined with other discounts or promotions.

18.3 Promotional benefits may be withdrawn where an order is cancelled, returned, refunded, or otherwise no longer qualifies for the offer, subject to applicable law.

19. Fraud Prevention and Order Verification

19.1 Visual Computers may conduct reasonable verification of orders to prevent fraud, payment abuse, identity misuse, or other unlawful activity.

19.2 We may request reasonable information necessary to verify an order or transaction.

19.3 Where an order presents reasonable indications of fraud or unlawful activity, we may suspend fulfilment and take appropriate action permitted by law.

19.4 We will handle personal information in accordance with our Privacy Policy and applicable data-protection law.

20. Privacy and Personal Data

20.1 Personal data collected in connection with purchases, enquiries, delivery, support, warranty, returns, and other interactions will be handled in accordance with our Privacy Policy and applicable Indian data-protection law.

20.2 Our Privacy Policy explains categories of information collected, purposes of processing, disclosures to service providers and authorities where applicable, cookies, retention, security measures, and available data-related rights.

20.3 By placing an order, the Customer acknowledges that certain personal information may need to be processed to fulfil the transaction, provide delivery, process payments, provide warranty or after-sales support, comply with legal obligations, prevent fraud, and perform other legitimate business functions.

20.4 Where consent is required by applicable law, consent will be obtained in the manner required by law.

20.5 Nothing in these Terms limits rights available to individuals under applicable data-protection law.

21. Third-Party Service Providers

21.1 We may use third-party service providers for functions including:

  • payment processing;

  • order fulfilment;

  • courier and logistics;

  • hosting and website infrastructure;

  • customer communications;

  • technical support;

  • warranty processing;

  • fraud prevention; and

  • other business operations.

21.2 Such third parties may process information necessary to provide the relevant service, subject to applicable law and contractual or other appropriate safeguards.

22. Intellectual Property

22.1 Unless otherwise stated, content appearing on the Visual Computers website, including text, logos, graphics, photographs, designs, product descriptions, layout, and other materials, is owned by or licensed to Visual Computers or the relevant rights holder.

22.2 Website content may not be reproduced, copied, modified, distributed, or commercially exploited without appropriate permission, except as permitted by law.

22.3 Product names, trademarks, logos, and brand names remain the property of their respective owners.

23. Limitation of Liability

23.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

23.2 Subject to the foregoing, Visual Computers will not be responsible for losses arising solely from circumstances outside its reasonable control, including third-party courier delays, manufacturer discontinuation, network failures, payment-provider failures, or force majeure events, except to the extent liability arises under applicable law.

23.3 Visual Computers will not be responsible for indirect or consequential losses to the extent such exclusion is legally permissible.

23.4 Nothing in this section affects statutory consumer rights, remedies for defective or deficient goods where applicable, or liability that cannot legally be excluded.

24. Force Majeure

24.1 Visual Computers will not be responsible for delay or failure to perform an obligation to the extent caused by circumstances beyond its reasonable control.

24.2 Such circumstances may include natural disasters, floods, fire, war, civil disturbance, government restrictions, epidemics or pandemics, strikes, transportation disruptions, telecommunications failures, cyber incidents affecting essential third-party infrastructure, supplier disruptions, or other comparable events.

24.3 We will take reasonable steps to resume performance as soon as practicable.

24.4 This provision does not remove any refund or other consumer remedy that is required by applicable law.

25. Complaints and Grievance Redressal

25.1 Customers are encouraged to contact Visual Computers first so that we can investigate and attempt to resolve any complaint promptly.

25.2 Complaints relating to orders, products, returns, refunds, warranties, deliveries, or services may be submitted using the contact details published on our website.

25.3 We will maintain a mechanism for receiving and addressing consumer complaints in accordance with applicable law.

25.4 Where applicable law requires a designated Grievance Officer or specific grievance information to be displayed, the relevant details will be published on the website and/or in the applicable policy.

25.5 Customers should retain their order number, invoice number, ticket number, photographs, and relevant correspondence when making a complaint.

26. Governing Law

26.1 These Terms are governed by the laws of India.

26.2 Nothing in these Terms prevents a consumer from exercising any statutory right or pursuing any remedy before a competent consumer authority, court, tribunal, or other forum where such right is available under applicable law.

26.3 Subject to the foregoing, disputes may be submitted to the competent courts having jurisdiction over the relevant transaction and/or the place of business of Visual Computers, to the extent permitted by applicable law.

27. Changes to These Terms

27.1 Visual Computers may update these Terms from time to time to reflect changes in products, services, business practices, technology, or applicable law.

27.2 The latest version will be published on the website with the applicable effective or updated date.

27.3 The Terms applicable to an order will generally be the version in effect at the time the order is placed, unless a change is required by law or expressly agreed otherwise.

28. Severability

28.1 If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary where legally permissible.

28.2 The remaining provisions will continue to apply to the extent permitted by law.

29. No Waiver

29.1 Failure by Visual Computers to enforce any provision of these Terms on one occasion does not constitute a waiver of its right to enforce that provision subsequently.

30. Entire Agreement

30.1 These Terms, together with the applicable product terms, order confirmation, invoice, Return Policy, Privacy Policy, warranty terms, and other terms expressly communicated to the Customer, constitute the applicable contractual framework for the relevant purchase, subject to mandatory provisions of law.
